Terms of Service

Effective date: 22 May 2026

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Etto Music (the "Service"), operated by MeSoft ("we", "us", "our"). By creating an account or subscribing to the Service, you agree to be bound by these Terms.

2. Definitions

  • "Service": the Etto Music background-music streaming platform and related applications.
  • "User": any person who accesses or uses the Service.
  • "Customer": a business that subscribes to a paid plan.
  • "Venue": the physical commercial premises (café, restaurant, bar, retail outlet, etc.) where the Service is played.
  • "Subscription": a recurring payment arrangement for continued access to the Service.

3. Eligibility

The Service is intended for business use by adults aged 18 or older. By subscribing, you represent that you have the authority to bind the Venue you register to these Terms.

4. The Service

We provide the following:

  • Commercially licensed background music streaming for hospitality and retail venues.
  • AI-curated playlists tuned to venue type, audience, and time of day.
  • Curated Etto playlists and a custom album builder.
  • Multi-device playback (iOS, Android, Android TV, macOS, Windows).
  • Customer support via email and in-app chat.

The Service is generally available 24/7. We reserve the right to perform scheduled maintenance with advance notice and to address emergencies without prior notice.

5. Account Registration

You may create an account at ettomusic.com using supported third-party sign-in providers (Google, etc.). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Sharing accounts across unrelated businesses is prohibited; each Venue requires its own subscription.

6. Subscriptions, Fees, and Auto-Renewal

  • Pricing: USD $8 per month per Venue. Prices are inclusive of applicable taxes unless stated otherwise.
  • Free trial: New Customers receive 7 days of free access. No payment is collected during the trial.
  • Billing: Subscriptions are billed in advance through Polar (our Merchant of Record). Polar handles VAT, GST, and other applicable taxes.
  • Auto-renewal: Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal.
  • Cancellation: You may cancel anytime from My Page. You retain access until the end of the current paid period.

7. Cooling-off and Refunds

We honour the statutory cooling-off rights of consumers in the United Kingdom (Consumer Rights Act 2015), the European Union, and Australia (Australian Consumer Law). Please refer to our Refund Policy for full details, including the limitations applicable to digital content where service has begun with the customer's express consent.

8. Acceptable Use and Music Rights

The music provided through the Service is licensed for in-venue background playback at your registered Venue and for use in social-media promotional videos of your Venue. The following uses are prohibited:

  • Redistribution, resale, sub-licensing, or downloading of tracks outside the Service.
  • Uploading tracks to any third-party platform (YouTube, Spotify, Instagram audio library, etc.) in a way that disconnects them from your Venue's identity.
  • Using the Service in venues not registered to your account.
  • Claiming authorship of any track in our catalog.

You remain responsible for any music or content you play in your Venue through sources other than Etto Music. Etto Music's licence covers only the catalog we provide.

9. Intellectual Property

All software, branding, playlists, and curation algorithms are owned by MeSoft or our licensors. You receive a limited, non-exclusive, non-transferable licence to use them solely as permitted by these Terms.

10. Suspension and Termination

We may suspend or terminate your account for material breach of these Terms, including unauthorised redistribution of tracks, repeated payment failures, or use of the Service for unlawful purposes. We will give reasonable prior notice where practical.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MeSoft's total liability arising out of or in connection with the Service shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the liability. Nothing in these Terms limits any liability that cannot be excluded under applicable consumer protection law.

12. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for temporary unavailability caused by maintenance, third-party providers, or events outside our reasonable control. Where the Service is unavailable for more than 24 consecutive hours due to our fault, you may request a pro-rata refund as described in our Refund Policy.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or via the Service at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without prejudice to mandatory consumer protection rights you may have in the country where you reside or operate your Venue. Disputes shall first be addressed by good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction.
